Legal Marriage Requirements in Canberra

Essential Requirements
To get married legally in Canberra, both parties must:
- be at least 18 years old, unless a court has approved a marriage involving a person aged 16 or 17
- not already be married
- not be marrying a prohibited relative
- understand what marriage means
- freely consent to the marriage
- give at least one month’s notice of intention to marry
- be physically present at the ceremony
These rules come from the Marriage Act 1961 and apply across Australia, including the ACT.
Notice of Intended Marriage
- Must be lodged at least one calendar month before your wedding date
- Can be lodged up to 18 months in advance
- Must be signed in front of an authorised witness
- Can be arranged from overseas if properly witnessed
- May be witnessed remotely in line with the current national rules
- Can only be shortened in limited circumstances

Required Documentation
Proof of Date and Place of Birth
You must provide either:
- a current passport, or
- a birth certificate
Proof of Identity
You must also provide current photo identification, such as:
- a passport
- a driver licence
- a proof of age card
If Previously Married
You must provide:
- a divorce order, or
- a death certificate of your previous spouse
Foreign Language Documents
- Documents not in English need an English translation.
- Original documents still need to be sighted.
- Additional explanation may be needed if names or records differ.
The Marriage Ceremony
Your marriage ceremony must have:
- an authorised marriage celebrant
- two witnesses aged 18 or over
- the required legal statements
- both parties physically present
- the celebrant physically present
- all required documentation completed and signed
You cannot get legally married online or by proxy.
After the Ceremony
- You’ll receive a ceremonial certificate on the day.
- Your celebrant must lodge the marriage paperwork with the ACT registry after the ceremony.
- You can then order an official marriage certificate from Access Canberra.
- The marriage is legally recognised throughout Australia.

Special Circumstances
Interpreters
- An interpreter may be required if either party does not understand enough English for the ceremony.
- The interpreter should be properly qualified.
- The interpreter cannot be one of the witnesses.
Minors Aged 16 or 17
- Court approval is required.
- Consents must be handled properly.
- This is rare and tightly regulated.
Shortening of Time
- Only available in limited official categories
- Never automatic
